Who Can Use SmartGains

• You must be at least 13 years old, and old enough in your country to agree to these terms or have a parent or guardian agree for you.
• Give accurate account information and keep your sign-in secure. You are responsible for activity on your account.
• Accounts are for one person and cannot be shared or transferred.

Training Is Your Responsibility

SmartGains is a training tool, not medical advice. It does not diagnose, treat, or prevent any condition. This includes adaptive training, recovery views, and data from Health Connect.

• Strength training carries a risk of injury. You decide what to lift, how much, and whether to train at all.
• Talk to a qualified health professional before you start if you have a health condition, an injury, or are pregnant.
• Stop if you feel pain, dizziness, or anything else that concerns you. Use a spotter and safe equipment where appropriate.

Recommendations and AI

Set targets, plan changes, and scores are calculated from the information you give us, so they can be wrong when that information is missing or inaccurate, and they cannot see how you feel on the day. Explanations and drafts written by AI can contain mistakes. Use your own judgment and check anything that looks wrong before you act on it.

Plans, Billing, and Cancellation

• Free: the free plan has no charge. We may change which features it includes.
• Trial: new accounts get a 7-day Subscriber trial. We do not ask for payment details, and it ends on its own without a charge.
• Subscriber: sold monthly or yearly through your app store, at the price shown before you buy. It renews automatically at the end of each period until you cancel.
• Cancelling: cancel any time in your app store account, or from Manage subscription in the app. Access continues until the end of the period you paid for. Deleting your SmartGains account does not cancel a store subscription, so cancel it first.
• Lifetime: where offered, a one-time purchase that unlocks Subscriber features for as long as SmartGains operates them and your account exists. Buying it stops the renewal of a live subscription, and the period you already paid for stands.
• Payments and refunds: your app store takes payment and handles refunds under its own policies. We do not collect or store your card details.
• Price changes: your app store will notify you of a price change to a renewing subscription as its rules require.

Your Data

Your workouts, measurements, notes, and other content remain yours. You give us permission to store and process them only as needed to run SmartGains for you, as described in our Privacy Policy. Only import or enter data you have the right to use.

Acceptable Use

Do not:

• Break the law or infringe anyone's rights through SmartGains.
• Bypass subscription checks, security, or usage limits.
• Copy, scrape, resell, or reverse engineer the service or its exercise media, except where the law allows it.
• Interfere with the service, or use it to harass anyone or send harmful content.

Our Content and Other Services

SmartGains, including its software, design, and exercise media, belongs to us or our licensors. You may use it for your own personal training. App stores, sign-in providers, Health Connect, and other outside services are governed by their own terms, and we are not responsible for them.

Changes and Availability

SmartGains is still developing. We may add, change, or remove features, and the service may sometimes be unavailable. If we shut SmartGains down, we will give reasonable notice where we can so you can request a copy of your data.

Ending Your Use

You can stop using SmartGains at any time, and you can delete your account in the app or through our account deletion page. Deletion removes the access attached to the account, including Lifetime. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires us to.

Disclaimers and Liability

To the extent the law allows, SmartGains is provided "as is" and "as available", without warranties of any kind, and we do not promise any particular training result. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of what you paid for SmartGains in the 12 months before the claim or US$50.

Your Consumer Rights

Nothing in these terms removes rights you have under consumer laws that cannot be waived, including those in the European Economic Area and the United Kingdom. Nothing limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence where that rule applies.

Changes to These Terms

We may update these terms as SmartGains changes. When we make material changes, we will update the date above and give additional notice when required. Continuing to use SmartGains after a change takes effect means you accept it.
